Command Climate Investigation

What is a command climate investigation? Sometimes commanders are faced with allegations from their subordinates of hostile work environments, or toxic leadership. These allegations don’t necessarily just apply to commanders, as allegations of toxic leadership can be brought against anyone who has a supervisory position over another. Once a higher level commander receives information of a poor command climate, the commander has the duty to initiate an investigation.

The command climate investigation should not be taken lightly. Over the past couple of years, commanders and staff in the highest levels of public trust and responsibility have been relieved of their duties. Additionally, investigations conducted on behalf of the command have been geared more towards the relief of the leader, as opposed to presuming innocence.

There are a couple of things you can do if you are the subject of a command climate investigation. First, seek the assistance of qualified counsel. As we continuously advise, counsel will assist you in steering the investigation. Second, DO NOT attempt to contact the complainants, or try to discover what individuals lodged the complaints. This could be interpreted as obstruction of justice, and also may be used as a benchmark to prove you are guilty. Third, begin preparing a list of witnesses who would be willing to provide positive information on your behalf. Gather the names and contact information, but DO NOT contact the witnesses yourself. This is your attorney’s job.

The collateral impact of a command climate investigation results in a direct fight for your military career. Substantiated allegations may result in your removal from position; issuance of a letter of reprimand; and the initiation of a board of inquiry. In short, the process of removing you not only from your command, but also removal from the military begins.

Because of the high stakes of a command climate investigation, you should seek out the advice of a qualified attorney as soon as possible. Schedule your FREE consultation with us below, and we will be more than happy to discuss your case with you.
